A Better Balance (ABB) is seeking an outstanding, experienced litigator with demonstrated commitment to public interest advocacy and/or pro bono work to assume a leadership role on our legal team as a Senior Staff Attorney. This position offers a unique opportunity to develop and engage in high-impact litigation on key gender justice and civil rights issues in a thriving organization with creative, dedicated staff and a supportive work environment.

ABB is a national legal advocacy organization with offices in New York, NY and Nashville, TN dedicated to promoting fairness in the workplace and helping workers care for their families without sacrificing their economic security. Through nationwide policy advocacy, legal services and strategic litigation, and enforcement and education, ABB is fighting back and improving workers’ lives at the local, state and federal levels. The organization has fought for and won victories in improved paid leave, equal pay, pregnancy and caregiver protections, breastfeeding accommodations, LGBTQ rights protections, and other women’s rights and economic justice issues throughout the country. Our advocacy work and legal efforts have gained national and international media recognition in dozens of outlets including The New York Times, Washington Post and The Wall Street Journal. We also provide free and direct legal services to low-wage workers and conduct litigation in state and federal court. Thus far in 2017, we have assisted over 450 people and have initiated cutting-edge class action lawsuits against two of the country’s largest employers challenging their unlawful pregnancy accommodation and absence-control policies and practices. Last year, the United States Department of Justice entered a consent decree in a case involving two of our pregnancy discrimination clients. With this hire, we are seeking to further expand our litigation portfolio to make an even greater impact nationwide, in recognition of the need for private attorneys general in our current political landscape.

There is some flexibility in job title and potential for growth in this position for candidates who have the experience and are interested in assuming greater management responsibilities. Primary Responsibilities:

Conduct nationwide impact litigation in state and federal courts and identify and develop potential new cases and litigation opportunities, including amicus briefs, that advance gender justice; Manage ABB’s advice and counseling hotline by training and supervising the litigation and direct legal services work of junior staff attorneys, as well as ABB legal fellows and law student interns; Undertake and support other ABB legal staff in conducting community outreach and education and developing training and self-advocacy materials on ABB’s core issues for advocates, organizers, and lay audiences; Work closely with ABB’s legal and non-legal program staff to develop and implement communication strategies that promote and magnify the impact of our legal work; Required Qualifications:

J.D. and active bar membership, preferably in NY, ability to waive into NY, or willingness to sit for the NY bar exam. Track record of substantial impact litigation experience, including experience in federal court. Demonstrated commitment to social, gender, racial and LGBTQ justice with a passion for achieving equity and economic justice for women and families. Proven ability to serve as lead or co-lead counsel in all phases of civil litigation and to successfully lead strong litigation teams that include individuals of varied levels of experience. Demonstrated ability to identify novel and innovative litigation approaches and opportunities, including by analyzing legislation for potential impact case opportunities and identifying legal tools to address and respond to emerging trends, particularly problematic industries, and changing socio-political landscapes. Superior legal research and analytic skills. Demonstrated ability to write and speak persuasively and clearly to a range of audiences. Experience supervising, training, and/or mentoring attorneys, law fellows and law clerks. Experience working directly with clients from diverse backgrounds and populations, including communities of color, low-wage workers, immigrants, and LGBTQ individuals. Experience working with external co-counsel or in coalition settings with multiple organizational partners. Ability to give feedback and resolve conflicts constructively. Ability to travel occasionally as needed. The Ideal Candidate Will Also Possess:

Creativity and excellent judgment in developing and executing litigation strategies. High degree of self-motivation and initiative, with the ability to create work plans and meet deadlines under time pressure. Experience working in a team setting and fostering a collaborative approach to case work and other advocacy efforts.
