ASSOCIATE GENERAL COUNSEL

THE POSITION:
Under the direction of the General Counsel, assist in providing legal counsel, representation and research for the Governing Board and administration.
Duties include but are not limited to:
Assist in providing legal counsel, representation and research for the Governing Board and administration.
Prepare and render legal opinions upon request of General Counsel.
Prepare and conduct administrative hearings including investigation of facts, testimony and preparation of pleadings.
Provide legal assistance in the drafting of legal documents, correspondence, rules and regulations, resolutions, applications and other legal or quasi-legal papers upon request.
Write, review and approve contracts for the District, including vendor contracts, construction contracts, architectural agreements and outside consultants; advise on District construction program, including stop notices and bonding issues.
Review State and Federal laws, regulations and guidelines; conduct investigations into charges that legal requirements or District policies and procedures have not been followed.
Advise and represent the District in unfair labor hearings, arbitration hearings, disciplinary hearings and EEOC/FEHA/FEPC/OCR compliance reviews.
Defend or assist in defending the District in PERB hearings. Represent or assist in representing the District in collective-bargaining activities, such as grievance arbitration, reviewing proposed contract language, filing, and defending lawsuits. Provide advice to the Personnel department.
Defend or assist in defending the District in matters brought forth under the IDEA and/or Section 504 of the Rehabilitation Act of 1973, and provide advice to the Special Education Department.
Provide a legal support for both educational and administrative programs proposed by the District and the Governing Board.
Advise and assist on student discipline matters, including but not limited to expulsion hearings and advising expulsion panels.
Conduct major litigation involving the District as directed by the General Counsel.
Serve as the General Counsel in the absence of the General Counsel
Perform related duties as assigned.
QUALIFICATIONS:
Knowledge of:
Education law, and Special Education law.
Labor and Employment law.
Constitutional and Administrative law.
Rules of evidence.
Student Discipline and Special Education law.
Civil procedure and Administrative Hearing practice.
Methods and procedures required to provide legal and quasi legal services to the administration and Governing Board.
Ability to:
Prepare and render legal opinions upon request of the General Counsel to the Governing Board and District administration.
Prepare and prosecute cases.
Conduct investigations and prepare pleadings and briefs; conduct legal research.
Analyze, interpret and apply laws, rules, regulations and policies.
Maintain knowledge of changes in the law and court decisions affecting educational institutions.
TRAINING, EDUCATION, AND EXPERIENCE:
Any combination equivalent to: graduation from an accredited law school, a valid license to practice law in the State of California and five years experience as a licensed attorney. Experience in education-related law, labor law, and employment/personnel law, special education law, or public-sector law is highly desirable.

Valid California drivers license
Member of the California State Bar Association
THE DISTRICT:
The Mt. Diablo Unified School District is one of the largest school districts in California. The District serves the cities of Pleasant Hill, Concord, Clayton, unincorporated areas of Bay Point, Pacheco, and portions of Walnut Creek, and Martinez. It contains 6 High Schools; 10 Middle Schools; 28 Elementary Schools; 1 Continuation High School; 1 Independent Study Center; 4 Special Education Schools/Centers; 2 Adult Education Centers; and 2 locations providing auxiliary services. It employs approximately 4,000 employees serving more than 33,000 students.
THE SELECTION PROCEDURE:
All completed application packets will be reviewed and screened in Personnel Services. Those applicants rated as the best qualified, based on the application packet, will be invited for an oral interview.

CONDITIONS OF EMPLOYMENT AND EMPLOYMENT BENEFITS:
A. Conditions of Employment
1. Oath of Allegiance: All employees are required to take and subscribe to an oath upholding State and Federal Constitutions.
2. Tuberculosis Clearance: Provisions of Education Code require new employees to present evidence of freedom from tuberculosis within 60 days of employment-employee bears cost.
3. Fingerprints: Provisions of Education Code require new employees to be fingerprinted at time of appointment - Employee bears cost.
4. Physical examination: A physical examination is required upon initial employment-employee bears cost.
B. Leaves and Holidays
1. Sick Leave 1 day per month (indefinite accumulation)
2. Vacation 2 days per month
3. Holidays 13 holidays per year
C. Insurance and Retirement
1. Dental Plan/Vision Plan: Premium cost for employee and all eligible
dependents is paid by the District
2. Health Insurance: The District contributes a fixed amount toward group medical and prescription plans for employees and eligible dependents.
3. Retirement Plan: Employee and District contribute to Public Employees Retirement System that is integrated with Social Security.
SALARY:
$120,060 to $145,935
+ $2,000 JD Stipend
(Max. of $164,761 with in District longevity
and stipend (2008-09 schedule)
